Thank you. This thread is heartbreaking and so disturbing to me. My kids are these kids' ages. My heart breaks for this little girl.

At 13 he has been taught about personal space and unwanted touching already. He knows! This teaching starts in daycare/preschool. He has also learned he can get away with it at home.

OP you don't need to know for sure what's going on. You don't have to have proof. By reporting it you're allowing someone with the right training and expertise to investigate and make the call.

If you don't report it, you are prioritizing the needs of everyone else over those of this little girl. Who cares if it's uncomfortable for you or your friend. Who cares if they are inconvenienced or have to hire a lawyer. What matters is that this little girl is safe, and right now you have good reason to believe that she isn't.

OP, you need to step in, since the mother is clueless. If you want to be gentle, tell the mom that now that her son has reached puberty, he needs to learn how to maintain and respect personal space and that lesson starts at home. While he may love his sister, the touching is inappropriate. If neither parent has had the talk about the birds and bees, they are several years too late and need to do that immediately. They need to make sure that the boy understands how to respect women/girls and their bodies and that includes his sister. If you think they are really that clueless, you can offer to help talk to him about appropriate personal space after they've had the discussion about sex and reproduction.
