Her money? I doubt she has any. His DW is following the old rule of thumb: in any relationship the person with the least to lose can be the bigger piece of garbage. She's setting him up to pay 18 years of child support plus alimony plus half the house and half the retirement.


There's nothing in the OP about the wife not working, therefore any discussion of alimony is premature. You also don't know that he's making more money. You don't know that he has a bigger retirement, or that the house is his.


What's the old rule, "Whoever has less to lose in a divorce will be the bigger piece of garbage in the marriage."

Adultery isn't seen as evidence of improper parenting. The judges separate someone's fitness as a parent from their fitness as a spouse. In short, no, just because your spouse cheated on you, you can't get more custody, unless you prove she or he is a danger to the child. In addition, it's virtually unheard of for a man to get sole custody of a newborn baby.


Referring to OP's wife as an adulterer glosses over a salient point, PP: OP's child is still is still inside his adulterous wife.

Unlike the case with most adultery, her adulterous behavior poses an obvious risk to the child. Her willingness to engage in an adulterous affair while pregnant suggests that the child's best interests are not of paramount concern to her.

It will give him grounds to file for separation, which he might need to prevent being forced to pay child support if the kid isn't his.

It might save him money in child support and build a case for a paternity test


OP, see a real lawyer, don't take advice from people who think they know the law because they watched an episode of Maury Povich. You don't need evidence to infidelity to file for separation/divorce, it won't affect child support if this isn't your child, and you don't need it to request a paternity test. What you do need is actual legal advice particular to the laws of your state about what you need to do in order to seek a legally-binding paternity determination.
