The label doesn’t change the immorality of the action. Gassing, destruction of property, and shooting civilians is even worse if there’s no war.

Nice try. Law enforcement is authorized to use tear gas as long as they announce two warnings to a crowd before they deploy it. The Chemical Weapons Convention does not prohibit its use by law enforcement.
