They're setting themselves up for a FOIA lawsuit if they are coded to delete. FOIA is the absolute easiest thing to sue on.

You'd have to FOIA the documents from OPM FOIA. Then on day 20, sue for non response. OPM will lose and they'll have to pay your court fees. If they no longer have the records, add that to the lawsuit.

No, you can't sue federal employees (not sure that Musk counts as an SGE). The Department becomes named in the lawsuit. Lots and lots of NGOs fund themselves through FOIA lawsuits. FOIA is impossible to do in 20 days, so the Departments always lose. It's become very expensive across the entire government.

The federal judge in the birthright citizenship case gave a little warning to DOJ attorneys by asking what kind of law grad would affirm they were making non frivolous arguments about that case. It's a hint that eventually judges are going to grow so weary of this crap that they will threaten to refer egregious DOJ lawyers to their bar.

+1 And Congress is probably not going to appropriate funds for people to sit around and do nothing for 8 months. Can you imagine how well that would go over back home? Case in point, my family back home has no idea this has been going on for week. I explained the deferred resignation thing to my brother (conservative but not MAGA) and he was like excuse me....WHAT? I told him about the "take a vacation" language, and I thought his head was going to explode. Fun times.

I had a friend laugh and say she was surprised I didn't take the 8 months vacation, like it was the deal of the century. I'm not even eligible.

If you are required show up, you go to the office. Even if this is in violation of your CBA. The union grieves AFTER you go back to the office. But you absolutely need to show up.
