Sure, but in Virginia you lose alimony and your entitlement to 50% for adultery, not for not wanting to sleep with your unattractive husband. So you’re legally entitled to fidelity regardless of how a very emotional poster on the internet feels about it.

I could have proven this easily but for an extra $40k that may or may not have been recouped. It just wasn't worth it since I wasn't going to get alimony anyway and then would have to deal with an angry ex-spouse who would have likely been vindictive. We made equal amounts of money. But perhaps I would have gotten a better deal on the house or some other financial matter. If there was a more strict rule as in if you commit infidelity you aren't entitled to X then I think I would have been able to negotiate that out of court or in court easier.

And in a community property state they’re absolutely right. What is your problem with this fact? The husband is equally entitled to her money— as seen in this thread— and to not have sex.
