Look at this slow motion video. It shows one Ice agent's hand empty a few times then shows him holding the gun - having disarmed the victim. The gun appears to me to have gone off as he is pointing it at the ground. You see the other agents all react, and then I think someone else actually shot the victim.
I guess it’s possible that the agent misfired but the victim never had the gun in his hand.
