1) criminal prosecution is generally a local government issue, not federal.

There are many reasons people may not identify with just a male or female gender identity, including scientific reasons.

There are 2 sexes - FULL STOP. Anything else is an anomaly - things didn't go as planned. There was a mistake during transcription or translation, and the process was thrown off track. The article you referenced is about a group of people that lack a particular enzyme, which is critical in converting testosterone to dihydrotestosterone. Did you even read the article? This is not the discovery of a new sex. This is the discovery of a group of people who lack an enzyme that is critical to the development of sex characteristics. This is the discovery of an abnormality.
If someone is born anything other than XX or XY, something went wrong. Full stop.
It's like saying that there are two ways people can be born - either with 10 fingers and toes or more than that - they can have 11 or 12. Some people do have 11 or 12 - but that's only because there was a genetic abnormality that lead to an increased number of digits. Humans have 10 fingers and toes - full stop. Anything else is an abnormality. We don't need to change anatomy textbooks to account for abnormalities. And we don't need to change the number of sexes to account for abnormalities.
