the defendant has a right to request a bench trial over a jury trial. It is a smart move since I cannot imagine a jury ever siding with the mother.

Her lawyer is claiming there are extenuating circumstances that contributed to the event. Specifically that she had several miscarriages, an ectopic pregnancy and PPD.
Look, I am very sorry she suffered loss. I’ve been there, I empathize with the pain. But I don’t see how this diminished her culpability.
