That’s not how anything works. You cannot force an independent third party to assume responsibility for bonds for which they have no legal obligations. And if DeSantis tries to play games with repayment of the bonds, ratings agencies will downgrade all of Florida’s debt because they will not longer be reliable on their repayment obligations, which would have severe consequences for Florida.
DeSantis can pass any law he needs to to make it happen. Oh and there are never any long term consequences for governmental defaulting. Specially when this is not really a government entity.
What you’re suggesting is unconditional. Just fyi. He can’t tax Disney extra because he doesn’t like their public political statements. What the hell is wrong with you?
It is absolutely UNFU--ING believable that some people (upthread) are CHEERING for a public official to punish a private corporation/entity/people for their speech. It is so cliche to say "this is how democracy dies" but it is LITERALLY HOW DEMOCRACY DIES. What DeSantis is doing is blatantly and clearly unconstitutional. And if you support that, maybe you should take up residence in another country more in line with your values. I hear Beijing is nice this time of year.
The poster above saying DeSantis can pass any law he needs to make it happen is either fundamentally ignorant or knows what he's saying is false and is just posturing. Either way, he is basically just trolling to rile people up. What DeSantis is trying to do is reprehensible and anti-American, but it will also fail.
You know just because you think it is unconstitutional for a governor to propose a law that will address the dissolution of a special taxes district’s bonds does not make it so. The Florida senate has 40 seats 26 of which are held by republicans and the house has 120 of which 77 are republicans. DeSantis has totally consolidated political power in the state and within the republicans party. He is also incredibly popular. He can pass any law he wants to pass. As demonstrated by what he just did.
So it is you who are ignorant and making false claims which you do not back up. You do not seem to understand what has happened, politics of Florida, etc, etc.
The piece you are missing is that even if Florida were to jump through the 5,327 hoops that would be required to follow through on dissolving Reedy Creek but sticking Disney with the debt obligation, it ultimately would have to survive a First Amendment challenge to SCOTUS. And if Florida actually goes through all 5,327 hoops, it will create undeniable evidence that Disney was targeted specifically based on it's exercise of its right to free speech. SCOTUS would not be able to uphold what Florida is trying to do without overturning Citizens United, and there is no way SCOTUS will do that.
Because the bigger piece you are missing is that even the most loyal right-wing SCOTUS justices are not loyal to DeSantis or the Florida GOP, they are loyal to the national party and FedSoc, neither of which want to touch this with a 10-foot pole. I mean, no one who matters outside of Florida is speaking up to back DeSantis on this, because they know what it would take to uphold it, and it is very much not in the interest of the Republican National Committee or the Federalist Society to allow that to happen. And when Trump has to face DeSantis in the 2024 primary, he will shred DeSantis over it too, which will give everyone else free license to attack DeSantis as well. Even if he wins re-election in Florida this year, he may very well have tanked his prospects for the presidency in 2024.
Why do you think this would make the supreme court? It will not get out of the Florida courts. You fail to realize what a third world place Florida is and the power of the courts to not take cases. The base loves dessntis because he is more trump then trump. The national R are hated. Hannity and tucket wlrun the show.
You fail to understand that, courtesy of Citizens United, it’s a First Amendment issue. Disney would file its lawsuit in federal court, not state court.
Disney will not do anything like that. Florida will pass a law where Disney has to assume the debt abs they will. Disney wants to get this behind them and make nice with DeSantis,

Disney, through Reedy Creek, has said unambiguously that Disney the corporation will not take on this debt. DeSantis is just counting on you being too gullible to think critically about how this will play out legally. But then again, Republican voters show themselves to be total rubes over and over again.

I don’t think it will get as far as SCOTUS. A US District judge stopped DeSantis’ big tech law for 1A infringement.

Are you really that dumb? Did you not take any high school government class?
The GOVERNMENT can not restrict free speech.
Private people are free to say and do whatever the heck you want in response to private people.
THIS.
Why the eff are people rambling about "free speech" when they don't know what it is????
And, even more why the eff, why do people NOT understand the constitution or the rights they have???

At the time of this writing, analysts predict that stripping Disney of their Reedy Creek district will saddle local Floridians with around $1 billion of Disney’s debt. Barring rescue from the state government, this could translate to as much as a 25% property tax increase for Osceola and Orange County residents. Perhaps most ironic is that Disney will effectively receive a $163 million dollar a year tax break, because they have now been absolved of their burden to maintain their own water, sewer, roads, and emergency services.
***
Like the rest of the country, Floridians have been swept up in rising energy, food, and housing costs thanks to forty-year high inflation. Saddling this subset of Florida taxpayers with economic liabilities in order to punish Disney would be reckless and short sighted.
When considering how significant the Parental Rights in Education bill’s passage is, despite all of its mainstream opposition, DeSantis’ targeted political retribution against Disney is somewhat perplexing. Although many conservatives feel Disney deserves the heat, there’s no denying that when a government official enters into the fray of punishing private entities for their political speech, no matter what political party they belong to, they are knocking on the doorstep of a First Amendment legal battle that could take years – and millions of dollars – to litigate in the courts.
