There are exceptions made for illegal aliens - some sanctuary cities, counties (official and unofficial) classify them as special ed due to language deficits to get around laws that would ordinarily keep them out.
What you are saying is that it actually is true. The same guidelines that apply to citizens also apply to non-citizens. There are not special rules allowing undocumented students to enter school at an older age than citizens. You are simply pointing out how some school systems apply the existing rules pertaining to special ed. Whether language and potential education deficiencies are sufficient to qualify a child for special education is something that can be debated, but the rules apply to all special ed students regardless of immigration status.
