My wife just got a check for $8.23 as well. I looked it up online, and also read the settlement agreement (PDF) that is linked to the site someone posted above, and the defendants agreed to pay $336 Million to settle this case, (it is a variety of credit cards, like Visa and M/C, and not just AMEX). Interesting is that the attorneys who filed this class action suit are getting 27.5% of that settlement for their work (about $90 million of it!) and up to $5 million in expenses. I guess that puts it into perspective. Seems OK to cash those miniscule checks, but the winner as is the case in most class action suits is the attorneys for the plaintiffs!

I remember filling out the paperwork, and I got my big check for $8.23. It is my biggest windfall to date, since the State of California determined that they had improperly charged me an insane amount to register my car there in 1996. Woo hoo!

I recall filing paperwork for a MasterCard suit like this, but not American Express. I was living overseas, and I had used my MC a lot, and had paid a lot in fees. I got back $37. I guess my share was larger because of that.

I don't understand what people think could happen if they cash the check. I would say once every 1-2 years i get some sort of payment like this. Once I even got 800 dollars from State Farm. I've typically received literature about the class action suit in the mail prior to the check, although sometimes the money comes so many years later I have forgotten about it.

I too received a check for the "massive" sum of $8.23 and was concerned about the legitimacy of the check (given the sophistication of scams these days). From the postings it appears that $8.23 was a nominal figure given to most people. If we are getting this amount, you can only imagine how much the lawyers are getting.
