The passive voice is insufficient in this situation. "Why didn't he let them respond before the white nationalists started killing and injuring people?" Primarily, the answer is that the First Amendment lets violent people like these white nationalists organize and speak even if their violent rhetoric and their fragile egos make assault on others entirely predictable. The City tried to prevent this, but a federal judge ordered them to let it happen.
