The SC already said that partisan gerrymandering is 100% legal.
The point is for gerrymandering to get so painful for the GOP that they come to the table to solve this at the national level with a constitutional amendment.

It’s not dems fault that the people in the red counties of Virginia decided to bite the hand that feeds them by voting for an administration that harms the people subsidizing them. I have no interest in having my tax dollars continually redistributed to people willing to vote for policies that harm my family and neighbors.

Virginia is attempting to compensate for all of the other Republican states that gerrymandered after Texas: Missouri, Ohio, and North Carolina. And Florida is on deck. None of those states offered it up to the voters directly, either.
