They are describing the mechanism designed by the board whereby Asian students who were previously eligible to apply, are now unable to apply for a majority of the seat positions.


But this is true of every student in the County. That's why this is a specious argument. The students who are at Poe also have a limited number of seats that they can apply to. Same with Hughes, same with Rocky Run, same with Luther Jackson.

This might be the single worst argument that one could make.

Point. Not is it fair to snatch food from one kid to feed another. It does not matter if the kid's ethnicity on the average still has a lot of food. That individual kid is harmed and this country recognizes individual rights not community rights.

Because they were talking about the number in reference to individual middle schools, which is a statement of fact.

Standardized exams have been found by both the recent California study and MIT to help identify high achieving economically disadvantaged students.

The root problem in the eyes of the district court is that the board knew the changes would reduce the percentage of Asian students at the school. There are no reforms that will both be effective and leave 75% of the student body asian. Either TJ exists to serve the best students are a few feeders or it exists to serve the whole county. The board chose the whole county and they were overruled.
