NY didn't really want to prove it, but they wanted to keep it on the table to maintain relevancy compared to the federal charges.
Without the terrorism charge, Mangione will be eligible for parole, eventually, on the state charges. The federal case will almost certainly yield a life sentence without parole. As a result, Mangione will likely end up serving his sentence in federal prison.
How many states have premeditated murder as Murder 2?
Most have that as Murder 1 and stronger charges.
NY downgraded it so it could upgrade terrorism deaths and killing police officers.
Glad the Fed case is there to right size that plotted murder 1 charge.
It isn't that different. Plenty of other states have parole-eligible sentences for their murder 1 statutes, requiring additional aggravating circumstances to impose LWOP.
The premeditated murder charges state by state stuff came out in December when everyone was shocked NY had it as Murder 2 only. Then a few weeks later they bumped it up to Murder 1 linked with the terrorism & stalking stuff.
Either way with the stalking, planning, murder, silencer, 3D gun, grossing state lines before and after, fake ID, running away manhunt he’ll get additive and max sentencing for each remaining charge.
