If you like litigation, maybe OGC at the VA is more suitable for you. You’ll never be in court at BVA.

Why would you leave a litigation position to go to the BVA? I mean, you have experience that many BVA attorneys could only dream of, i.e., litigation experience. I suggest getting a job that will put your litigation skills to good use. Luckily, the federal government has many litigation positions.

In 2017, BVA implemented a writing skills test because many of their new attorney hires couldn't write coherent decisions. BVA management has since eliminated the test because it weeded out so many candidates. That's good news for that poster, as the change is a sign that BVA can't hire enough people.
Since when did they eliminate this test? I was hired back in 2020 and I had the test
Second half of 2021, if I recall correctly.
It was a dumb test - I can’t imagine it provided useful information. Timed test and you couldn’t cut and paste - most of the job is cut and paste, so it was pretty unrealistic. Probably unwieldy, too. Don’t know why the troll keeps saying it was to determine whether one could write - I think it had more to do with whether one could do legal analysis. They don’t need writers, they’ve got plenty of tools for cutting and pasting [not going to use the name of the tool or troll will use it to pretend he worked there]
Wonder if they every looked at the correlation between test scores and attorneys who were good that the job
Don’t you think writing well goes hand in hand with legal analysis? I mean, people who are poor writers are usually terrible at legal analysis, as they are unable to convey their reasoning in a clear manner. That’s probably why BVA implemented a writing test.

I would not count yourself out just yet. Government hiring takes forever. BVA is especially slow. I got some automated rejection notice from OPM at one point then three weeks later I was contacted for an interview.

The union was working with a private law firm years ago on a class-action suit for unpaid overtime, but I don't know what happened to that effort. Didn't DOJ lawyers win a similar suit a few years ago?
Correct, but that was due to specific facts that the court found that they were unable to prove. It could be that BVA attorneys will be more successful, or at least draw a more favorable judge at COFC.
