My school bus driver smoked everyday during the ride to and from school.

Exactly. Because society has decided that we are still going to yield to smokers' right to smoke in a way that pollutes everyone else's air. We all know about second hand smoke; we all know about carcinogens found in second hand smoke. And yet in 2021, we still yield to the smokers who subject people to their cancer causing air in multifamily housing, etc. It's not just unpleasant or a smelly nuisance- what they're doing causes real harm. If you want to talk about freedom, you need to talk about my freedom to have good air in my home- not the smoker's right to pollute it.
When my neighbor smokes, I do something crazy: I close my window for 5 minutes (if it's open). Problem solved! It's a pretty easy problem to solve. I do the same when there are kids outside being young, people playing music, dogs barking, etc.

I think there's a high bar to prove a smoking nuisance. There was a lawsuit a few years ago in Greenbelt where a neighbor (shared wall) sued because the HOA wouldn't stop their neighbor from smoking outside. The court basically said that the neighbor going outside a few times a day wasn't a nuisance and that the complainer should close their windows/get a fan.
I think there's a big difference between someone who goes out to smoke a few times a day vs. literally chain smoking up a storm all day every day. The former I could deal with. The latter I couldn't tolerate. This is city living. You're going to have neighbors who live life differently than you do. As long as their habits don't prevent you from reasonably living your life, then live and let live. And someone going outside a few times a day to smoke isn't going to ruin your life or health.

Maybe (though I don't really see why that'd be a good use of public resources), but in this case, OP is talking about neighbors smoking on private property, which is legal.
