OP, your gripe should be about the existence of the technology and not the law itself. There's no reason for anybody to think that texting and driving is OK. As for the government use of the technology, c'mon who are you kidding here. If the government wants to voyeur on whatever activity you're doing wherever you are, it can and it will. It doesn't need a traffic camera as a conduit/loophole to do so. Also, these technologies may serve (or may have already possibly served) important national security purposes, i.e., avoid terror (both foreign and domestic) attacks.

technology has already solved this problem, crash avoidance will stop the car when a pedestrian is in front of it so the driver doesn't have to pay attention. why aren't we using technology to solve problems instead of outdated laws.

How is talking on a phone on Bluetooth different than talking to someone who is in the car with you?

It's definitely distracting. I see it all the time as a pedestrian - people breaking randomly, not paying attention to their surroundings, being distracted on their wireless phonecall. In my opinion, it should absolutely be illegal.

Right, but OP didn't specify. You can't possibly ticket someone for talking on the phone when you have it on speaker or routed through the car's system.
