So glad that you updated! It sounds like the best ending and that you will do your brother proud raising his child and keeping him in touch with his grandparents. I'm so sorry (again) for your loss.

Stop litigating the OP's case (or the ILs case), folks - it's done, and it sounds like a happy ending! Congratulations to all of you OP! It sounds like you have a wonderful family!

And what would the op need it for? She is engaged to a pediatrician and making a good salary? If she ws to take on the child when no-one else wants the kid, and on a smaller income, it could be ok. In this case the kid has relatives who are not any less distant than what she is, and willing to take him on.

Will the court not appoint a guardian ad-litem to look after his financial interests?

You are ridiculous.

I'm so sorry for your brother's death, OP. My brother died nearly four years ago and it still breaks my heart that I can no longer see my nephews regularly anymore. (His widow is alive, but unstable, and she has generally shut our family out from seeing the children.)

You are very, very good to be making such an effort to keep your nephew part of his mother's family's lives. I know it will be a struggle, but I'm sure it's what your brother and SIL would have wanted. They chose well in choosing you as a guardian!

(And unsolicited opinion on the trust fund -- use it for the child. I don't know many people who want their child to inherit huge wealth at the age of 21...it's a disincentive to work hard and be entrepreneurial. If tapping into the trust can make the child more comfortable and allow you and DH to build additional family without overstressing yourselves financially, I'm sure your brother would not have wanted you to sacrifice your own retirement and your comfort along the way in order to provide what the trust is already ready to provide for his son. Think of it that way - it's a way to allow your brother and SIL to provide for their child.)
