Nope, not according to the communications guy from prosecution at the Council meet n' greet. We brought up carjackings (a friend of ours has been carjacked in DC), and according to the rep, "carjacking cases are very hard to prosecute because who is to say the person who is found with the car is the one who stole it?" So... they don't prosecute. Interpret that as you will.

I mean this is probably true most of the time. People steal/carjack cars and give them to other people. If the car is obviously stolen, say a broken window with a hot wired ignition, there's charges you can prove more easily, but if a person is operating a car with a key it's harder. The conventional wisdom when I was doing criminal defense work 20 years ago in another jurisdiction was that those cases were generally winnable.

What in the world is the logic of this? If a diamond necklace is stolen from someone and a person is found in possession of that necklace surely they can reasonably be charged with theft? Same with just about any other stolen goods. What is special about a car that we would think innocent people are just routinely driving stolen vehicles.

And why not at least charge with possession of stolen goods. If they want that charge dropped they can give a name of who they believed gave them lawful possession of the car? If you’re found with a vehicle that is stolen and you are innocent, you should have a reasonable story as to how this happened. Hand over the name.

Definitely reasonable! We make it a point not to get gas with our kid in the car. The only exception is Costco (we usually all go). It’s hard to comment on this story without feeling like I’m minimizing the car theft/carjacking problem that we have in this city…but what this parent did was beyond the pale. Completely unacceptable even somewhere much safer than DC.

Not irrational, former AG Karl Racine spoke of keeping cars topped up so his girlfriend and their young kids would not have to stop for fear of risks. Not irrational at all. Better than a mom who leaves the baby to buy perfume!

Not irrational at all. I don't even leave my dog in the car unlocked while I'm pumping gas. Very rational to worry about a child. I am a long time away from having to handle a kid in a carseat. Just thinking of it now makes me remember how vulnerable a parent is in those moments of getting a child into or out of the seat.

They have had DC Justice Lab speak at ANC meetings. One after Pinto's Emergency Bill passed in June to strategize how to push back on the temporary provisions.
