There is no death penalty in NY.
Does NY even have life without parole?
Does it really matter? If you can stack up life sentences. Plus eligible for parole doesn’t mean you get it.

It seems like the big break is that when he first met one of his victims, a boyfriend was there (they were pulling a con of sorts). He witnessed the guy’s car. And since he used the same phone the next day to contact her again, they looked for guys with that car.
Then once the car made him a suspect, they were able to track the location of all of his burner phones and all his online activities.
Then they got discarded DNA from him and his wife and did some fancy mitochondrial stuff with hairs found on the victims. His wife wasn’t there but it sounds like they think her hair was.
I’m sure they’re hoping they’ll find more evidence now that they can search his house. I hope they do too.

Was it just a terrible coincidence that he picked her up and she was hallucinating when she called 911? Or did he somehow follow her out there?
That’s the big mystery. Gilbert might have just been coincidentally connected. She ran away from someone bad. In searching for her they found all those people. I suspect escorts meet many, many unsavory and murderous men.
The audio of Gilbert and a police dispatcher was haunting. Dispatcher kept her on the line for so long trying to get an address. Gilbert was high on whatever. But she had lucid moments of detail. The alleged boyfriend and another man were trying to calm her down, promising to take her home. She knew she was in danger. Didn’t agree to be taken anywhere in a car. She fled the house, and a neighbor did attempt to help her, but she kept running along the beach. The neighbor called 911.
An independent autopsy found no evidence of drugs in Gilbert’s system.

Was he arrested by Suffolk county police in nyc with nypd cooperation or does nypd have to do it and he is turned over to Suffolk? Was he then driven all the way out to happaugue or Riverhead for the photo?
I think NYPD officers would get him into custody along with the Long Island detectives who were investigating. Then the LI guys would take him there to get booked.
Yeah, they were initially planning to move on him about a week later, they were convening a grand jury, etc., but it got leaked. Since they were monitoring his online activity, they knew he was closely following the investigation and were worried he would get wind and flee. His wife is from Iceland which made him an even greater flight risk.
