The Supreme Court has officially become a joke. I, like a gazillion other people on here, went to law school. I loved appellate practice and procedure, participated in moot court competitions all over the country and I loved it. I though a career in appellate law was where I wanted to be. It's kind of sickening to come to the conclusion that people that were held up as models of fairness, intellect, and measured jurisprudence are really just partisan hacks.

Honestly, this applies to the whole legal profession - lawyers have allowed the partisan nature of the bar by not policing their own. Lawyers have increasingly made ridiculous arguments before the courts often based on hiding or false information or legal theories that go far beyond novel but credible arguments and in the Executive Branch - those lawyers should be disbarred and instead they are supported and protected by the legal system. And this didn’t just start with crazies like Giuliani and Lin Woods. Why the guys from OLC who argued that torture wasn’t torture (John Yoo) could leave OLC and go back to his job at UC Berkeley Law is beyond me.

The bar needs serious reform. It protects white conservative lawyers at the expense of the rest of us.


While I agree about the first part it should be fairly obvious that John Woo isn't white. This isn't a racial issue and it hurts your argument to make it one. Too many lawyers are too willing to believe the ends justify the means. Too many lawyers view laws and principles as obstacles to get around.

NP here: agreed. I think this leak is coming out of the chambers of one of the Republican-appointed justices. Either to keep a wavering justice in line or to sway someone to a more moderated view.

Democratic-appointed justices don't gain much from leaking this. Better to have let the final decision drop like a neutron bomb this summer, closer to the date of the midterms.


I dunno. The earlier the better I think since this is before the primaries. This will galvanize the left if not, then I don't know what will.

The liberal justices don’t want Alito’s decision issued at all. They would rather see a pared back version that still preserves Roe (since they know they’re not going to get the Court to go completely the other way on this case). If they can’t accomplish that, then any value Democrats might get from this in November (which is still very speculative) would only be a consolation prize.

I think this has woken the people. The GOP is dead. I’ve said for years it’s a zombie party, alive only due to the goofer dust of cheating, right wing propanganda and dark money. This will find it beat into pulp.


I’m sorry but this is a delusional stance. I saw this sort of thing written after the 2020 elections too, and now the GOP is poised to take back the house and senate. This court will be at this balance for years to come, doing everything the GOP lawmakers told its voters it would. I think we will look back at Biden’s win as a brief pause from our descent as a country.

They already weren’t. I posted about 35 pages ago that the polling had already begun to move back toward the Democrats. You think seeing the fascism clearly is going to help the GOP?

But it has done irreparable damage to SCOTUS and legal experts and those who are paying attention understand that.

I have no doubt the leaker will be identified.... maybe not publicly.... but he/she will be discovered. And, this person has destroyed his/her future in law.

Overturning Roe on a conservative/liberal split will do irreparable damage to SCOTUS. The facade of the impartial Justice was already waning, it's gone after this.


The leaker will do very well for themselves, and I say that regardless of party affiliation. If the leaker was a FedSoc type trying to keep an errant Kavanaugh in line, they will be hailed as a hero for fighting to the last. If the leaker was a liberal, they’ll be hailed as a hero for taking one last stand to defend womens rights. Many progressive top law firms will have no trouble with it, and as a client of those firms I would have no problem hiring a litigator with that background.


Even if that litigator has no license to practice law? Because that is pretty much inevitable.
