This case was tossed only on the legality of the appointment of Halligan, not the merits. The DOJ will appeal to the 4th circuit. The 3rd circuit already held oral arguments on the validity of Huma Abiden, so its possible that by January the indictment will move forward.

That is a different issue. That is tolling of the statute of limitations. Epps is referring to extending it.

But in either case, the government is more likely than not to lose on the issue.

They couldn’t find anyone dumb enough to risk their bar license to bring this case in the first place, so I wish them luck on finding another attorney. The court will be appointing the next attorney for that position.
