If the conduct is only a state crime (e.g., sexual assault under New York Penal Law), then:
The state prosecutor (e.g., Manhattan DA) files charges.
The DA requests the DOJ’s Office of International Affairs to make the extradition request on behalf of the state.
The U.S. Secretary of State transmits that request to the U.K.
Even though it’s a state case, the federal government must formally send the extradition request.
