So full of herself!" She really can't win. I think she handled it very nicely and was brave enough to speak to him. I probably would have avoided all contact with him because I hate confrontation. But she was very poised and mature. Good for her.

Where does it say this? So the jury doesnt decide the legal fees?

The judge ruled earlier that they would have another hearing on it after the verdict, if the verdict went for GP. Apparently, in Utah, you have to prove that the plaintiff sued in bad faith to be rewarded attorney fees. The attorneys will need to prepare and argue those elements before the judge, not another jury,

When you ski, you.know that you are responsible for not colliding with people in front of you. It's the rule. It's posted on large signs everywhere. It's in the waiver you sign when you buy your lift ticket.

I don't know if there's legal precedent, but it'd be understandable to sue someone who caused a collision due to skiing recklessly and irresponsibly in a slow zone.

But that wasn't the case here. If he was behind her, even IF she accidentally cut him off, he's the one who is responsible for avoiding her. If she had been skiing fast and out of control, witnesses would have noticed.
