Not sure what you want the criminal justice system to do to the kid. If it were 10 years from now and your kid what would make sense in your mind?

Yes, it is scary when you RUN A RED LIGHT and hit a FAMILY.

Good reminder that you shouldn’t hit the gas when the light turns green until you’ve looked both ways to make sure nobody ran the light. That’s just common sense.

Amen. Same goes for pedestrians crossing a street. I see so many people just start walking into the street without looking in either direction when the light changes. Idiots.

It doesn’t sound like OPs DW hit the gas when the light turned green (there’s no way she’d be going 35mph at that point) It sounds like she drove through a green light at 35mph (totally legal) at the same time the teen was running a red light (totally illegal). The kid is at fault and his parents insurance needs to pay.

Np. Not an expert here but wondering if there is any tort law case against the parents for negligence. The parents knowingly had their unlicensed kid driving a car - which seems like pretty obvious negligence, ie. an event that could foreseeably lead to injury to someone else. This depends of course on whether the learners permit requires a licensed driver in the car. If no adult required, then there’s no case on this point.

Anonymous wrote:Fault for your insurance claim has nothing to do with the driver being unlicensed. Did the police report state that the other driver ran the red light? That’s all that matters here, not the learner’s permit issue.

This. The fact that he only had a permit has nothing to do with your ability to recover for the damage to your car.
