This isn't at all true in NOVA. If you want 50/50 you'll get it.
Is this really true? How do you know?
1. Consulted several divorce lawyers, who all said this
2. Wanted and got 50/50 myself
This is probably the wrong message thread but I'd love to have more information on how to get my kid more. It's closer to a 40-60 split now and I'd like that reversed.
courts are very reluctant to change an existing custody agreement without very good evidence that the new arrangement is vastly better in terms of the children’s best interests (not your interests or your convenience). In addition, asking for such a small custodial change is a waste of the court’s time unless it results in a significant improvement in the child’s best interests.
The time to ask for 50/50 is at the first custody agreement. And if you want to be sure you get 50/50, then you have to be sure you are doing 50% of the parenting prior to the divorce.
Were you 50/50 parent before divorce and did you ask for 50/50 at first custody agreement? If yes to both, what were the reasons you did not get 50/50?
