I have a friend of a friend who is leaving to move back to her home state - where she has the support of both sets of grandparents - and somehow it's being allowed. She already has a lawyer (not sure he has one but I bet he does).

Perhaps the husband is feeling guilty since he is the one who wants out and won't work on the marriage, etc, and they haven't even started divorce proceedings (the announcement that he wants a divorce is about 4 weeks old) but she's moving back home, bought a home and everything.

OP just talk with your EX. Chances are if he checked out he's good with the kids visiting form Christmas and Summer


So because he wants a divorce, he has no interest in his kids anymore?
