Private institutions can do what they want. SCOTUS has articulated the standard in a recents string of cases for publics. What is the DOE doing again?
And BTW-- white parent here with a kid at TJ. The students who have a legit beef about being held to a higher standard in college admissions are Asians-- especially inIvys and STEM programs. My kid will get in to a college with a lower GPA and lower SAT that his Asian classmates.

No they can't. Do you think a restaurant can refuse to serve black customers? Or a school to admit black students? It's all prohibited by federal law under the commerce clause.
