This is an old thread OP pulled up for attention. She said Dad has no contact so its a non-issue.

Op I'd email him and say you are thrilled! To start visitation. Offer some day time meetings with you, then some day time meetings where you leave them together, with a goal to work up to overnights *IF* he has an adequate place for her to sleep. It is in your child's interest to have a relationship with her dad unless he is a danger to her.

No need to go to court.

OP here. Who ever made this comment was absolutely correct. He didn't have a new girlfriend but a wife. 2 years later and his visitation or lack thereof is non existent. He saw my daughter only once last year. And so far twice this year earlier in the year. Made no attempts to see her for her birthday either. He hasn't made any mention of wanting to see her or taking me to court.

Based on the information you've provided, my gut reaction is also that he wants to establish partial custody to reduce child support payments.

In your shoes I would see a lawyer, but in general, I would be very open to increased visits, but I would try to hold off on overnight visits as long as possible. It doesn't seem like a healthy environment for your child. A kid with asthma should never be in a home with a smoker. That would be my line in the sand so to speak.

Update: He did show up to her dance recital. He watched her performance. After the show he snapped 2 pictures then said he had to go. With me being stuck to explain why he didn't stay longer, I haven't seen my dad in so long, he just took pictures and left, etc.
