Have you been on dates with anyone else since the "separation"?

Well, to be honest, I have only gone out on one date.. and this is the thing.. I want to move on.. but I don't want to hurt the spouse in the process.. (unevitable of course) and when I went out on this date with this guy (who I still speak with ) I told him the truth.. I try to be as honest as I can.. because it is only fair I guess....

That is a very good question.. and believe I have thought many times of that... you know.. "what if he was able to get his papers ., would that change my mind?" ... honestly.. I don't think it would.. because..first , he does not have enough education to be able to get a job that would pay a decent salary, and second... we are so opposite in our personalities.. I know opposites attract, but we are way beyond opposite lol!!.. and I feel I am done with his calm attitude.. none ambitious.. and I honestly don't trust him enough to take care of the bills and stuff. I am the type that is on the ball with everything.. bills paid on time.. things taken care of.. he is not like that.. and I think that bored me.

If he could get papers, and got a job, would you reconsider leaving him? Does he even have enough education to be able to get a job that would pay a decent salary?

Even if the spouse is illegal??

Yes, and given he is the kids primary caregiver, it's likely he will be given primary physical custody and you will also end up paying him child support

WHAT!!?? that is not fair at all!! .. I mean. is it my fault that guy doesn't freaking move!!!! ??

Talk to a lawyer. Who practices in AZ. Don't take legal advice advice from a message board targeting people who live in DC. 1) bad idea to take advice from a message board and 2) domestic relations law differs from state to state.

I did, and when he told me.. he said he had an expired visa.. He never mentioned that he had entered through the desert, .. after dating him for only about a year.. I told him "let's get married" .. first to help him get his papers so he can see his mom.. and second because I thought this guy is a humble/nice guy .. after we married.. I contacted a lawyer to start the petition and I told the lawyer.. yeah.. he has an expired visa.. The lawyer insisted on if that was true because once the process begins, if we are caught in lies.. it is worse.. I asked the spouse and he then confessed.. that he never had an expired visa.. I wanted to kill him.. so yes.. I knew he was illegal.. however didn't know. .it was going to be impossible to get his papers..
