Well, keep in mind that private school families pay taxes. If I remember correctly, the lawsuit made the argument that transportation and schooling were separate services. Parents of private school students pass on the free schooling, but not the free transportation. And as they were paying for both, they should receive the services they choose.
Of course, busing individual kids to any one of dozens of private schools it is vastly more expensive than busing kids who live in the same neighborhood to the same neighborhood school.
