There is zero chance that the decision to seek an indictment is going to be made at the AUSA (i.e. career prosecutor) level. It will be approved by Garland himself. He personally approved the search warrant, which was far less consequential than an indictment would be.


Sure, he may give an official stamp of approval, but he most likely will follow the recommendation of the career prosecutors specifically to avoid the appearance of political motivation.

Agreed. The only problem is that now Trump is a candidate, he will be able to accuse Biden of leaning on Garland even more so than before, and create and entire campaign of victim-hood around it. So Garland will be even more careful and cautious. Which means we might ever see an indictment!

Grand Juries will indict whoever they're asked to and no career DOJ attorney is pushing to indict a former president without approval from above


This. Utter fiction that the prosecutors involved are operating independently on this. POTUS will keep his distance from the AG, the AG calls the shots at Justice. And in this case, I’m really not sure what he’s doing.
