The Supreme Court isn't in charge of the Attorney General or the DOJ. The AG can reaffirm independence from the executive office.

Also, the second paragraph in that section should be read in light of the first section. Had DOJ sent out the letter regarding election fraud, then that would be an unofficial act with merely-presumptive non-absolute immunity.
