Can you explain subordination of perjury? You mean the lawyers know that the documents are not, in fact, declassified so they won't get involved in saying that they were?


It is a federal crime to introduce, or cause to be introduced, testimony or other evidence, including an affidavit, known to be materially false.


Subordination prosecutions are rare but would you put your license to practice law on the line for Trump in a circumstance such as this? It appears none of them will do so. They gave away the game.

We potentially learned two things from todays proceeding. First, Trump apparently will argue that once he scribbled some notes on a classified document then he is entitled to keep it, as opposed to maintaining control in a SCIF. Second, the documents found at MAL were of such a highly-classified nature that DOJ hasn’t made the determination that some of the case team prosecutors have not been cleared for the compartmentalized or code word program. This is astonishing. This is the kind of material just sitting in a box at a beach resort. No wonder DOJ has dropped the hammer.

They appear to have really misplayed their hand with a no-nonsense senior judge having FISA experience. There may not be enough rope in Florida for Cannon to throw them a lifeline.


Trump's lawyers specialize in spewing non-sense. I am confident in their ability to come up many many crazy arguments that Cannon will then agree with.
