That’s helpful. Until MA laws are enacted here therefore, do we think $50 extra a week for OP’s aupair is not misplaced then?

DP. Even at the very minimum 200/wk that is about $10,500. We pay about $15k or so as were above stipend. Program / agency fee / required education credit fees = about another $10k. That covers visa costs, health insurance they get through agency, etc. Most people allow their au pairs to drive so they are added to insurance. That cost an extra $1500 per year for us, not including any additional car costs (hello car accidents...). We gave $500 for Christmas plus other gifts, $500 for birthday, and $500 for second year bonus. We had intended to pay for a RT ticket home between first and second year but covid shut that down - we’ll pay for that when we’re able. Will probably give a couple thousand bonus before her travel month. Food is also obviously an extra cost that I don’t add in but it is an extra person and we often host her friends for dinner. We took her with us on vacation so plane ticket (did girls day with lunch and spa we obviously paid for). We go to events that we invite her or her friends to join and we cover all costs. I mean none of it is huge costs but it adds up so I could easily see how someone gets to $30k. We’re probably there as well.

Don't forget the cell phone with unlimited data, gym membership (preCovid), gas allowance, uber allowance (so she is never tempted to drive after drinking), and the cost of keeping a second car just for the au pair.

I've tried several times on this thread, but it's pointless. You're clearly a disgruntled nanny who has too few skills or motivation to actually get a job that you'd actually enjoy. So now you're taking your rage at having to care for children (which you consider to be a terrible and exploitive job at its core) out on host parents.

Yep. The current stipend is calculated off of a federal minimum hourly rate of $7.25 which is roughly half that in DMV at 45 hrs/week. Then 40% is deducted for room and board where max DoL deduction is $77. So just there, you’re shorting the au pair $55/wk (OP $50). Not to mention the state minimum should prevail.

Given the DoL max deduction for live in of $77, all the people who claim that $200/wk or less for a live in nanny is not illegal must be wrong. At normal working hours they are paying well below the minimum federal wage of $7.25 and a fraction of DMV minimum hourly wage. To the OP: whatever you do, please don’t intimidate your au pair with the script another PP suggested on page 1 which was thought to be “great advice”. I did an informal poll that included mothers, fathers, law firm partners, teachers, doctors, and even teenagers with au pair experience. I read the original post, the script, and the response. The reaction was universal: disgust. Several people said “these people are disgusting”. I think that’s too harsh, but the actions have been fairly poor for way too long. There was not one person who thought the advice was great. On p 26 we all know a lot more than we did on p 1 and hopefully things will change soon.

There is a bill pending in DC too.

Simply stated, what is happening in today’s domestic worker market, including au pairs, is not fair or justifiable. That will hopefully change soon by law, like in MA. Until then, the only right thing to do is to voluntarily adopt the MA law standards or do better than that. Instead, many families have fought against these laws. That says something about us that we can hopefully change.

Domestic Workers are denied basic labor rights. The issue is not whether one can get away with following the minimum letter of the law, but whether their actions are justifiable knowing that the law should be (MA laws for nanny’s and au pairs) or ethically justifiable.

When most of our country’s labor laws, like the Fair Labor Standards Act, were drafted, domestic workers were not included. There are pending bills in DMV and in the Congress that will change that soon. Workplace standards like a minimum wage, overtime pay, or protections against sexual harassment in the workplace are rarely extended to domestic workers, if at all. Many domestic workers do not earn a living wage and work without access to health care, paid sick days or paid time off.
