He lacks the most basic information to make an assessment regarding classification. Is the expectation that there will be an evidentiary presentation snd mini-trial as to each document and photograph, with witnesses from the intelligence community explaining the basis for classification? And what evidence could TFC possible adduce in rebuttal? The only alternative would be to decide whether Trump had the power of transubstantiation when it came to classified documents. TFG will offer the testimony of Kash Patel to the effect that he waved his hands in the air and repeated “declassified” three times while hopping on his left foot. It’s absurd.
Yet the district court here ordered disclosure of highly sensitive material to a special master and to Plaintiff’s counsel—potentially including witnesses to relevant events—in the midst of an investigation, where no charges have been brought.

If they get the same treatment as Trump, it makes it essentially impossible to even conduct an investigation, much less prosecute them. They can bottle up all the evidence with a special master while they argue whether it is really classified, whether maybe it's privileged (can't just take DOJ's word for it that classified documents aren't subject to spousal privilege!), etc. If you take it seriously, the Espionage Act is a dead letter.
Do you think SCOTUS will overturn established precedent with regard to treating everyone the same or say this only applies to this case? They seem to like do that.
