At this point in history, it's very possible. And possible the Supreme Court affirms. I don't think it's hugely likely, but it's possible. I realize all the talking heads will say it's not so, but to my knowledge, the extent of Presidential declassification authority, for classified materials that are not subject to another law or statute, has never been litigated, or even really discussed. There's certainly no statutory procedure, and there's an awful lot of Supreme Court justices that subscribe to the unitary executive theory of the presidency.
Did DOJ challenge Cannon's jurisdiction over the case? Because I would hope that's still ripe for appeal and the higher courts could use that as a get out of jail free card, so to speak.
