Have been told by supervisors that my agency (health related) applied for exemptions for those with start dates after Feb 22 and supervisors were recently told by HR that exemptions will not go through. Sounds like HR or guidance they are being provided by administration does not involve a loose definition to the exemptions. Supervisors a little surprised given our work scope. Good luck to all those in limbo.

I was told a week ago that the agency that made me a TO before Jan. 22 was going to petition for an exemption to get me hired. I haven't heard any more yet.

Looks like several agencies are still moving through the process. I was referred today, for a job that definitely is not critical or related to national security (but it would be an awesome job though).

Has anyone heard from DOJ that had a tentative offer before January 22nd (and accepted) but do not have a confirmed start date yet?

Here's the guidance our agency recently received.

Under terms of the freeze, hiring actions fall into the following categories:

• Individuals who received a job offer/appointment prior to January 22, 2017, and have received a final offer letter that specifies a confirmed start date on or before February 22, 2017 can be hired as scheduled. Human Resources will contact each selectee to confirm the onboarding date and respond to any questions they may have.

• Individuals who received a job offer/appointment prior to January 22, 2017, and a final offer letter that specifies a confirmed start date after February 22, 2017, cannot be hired until a request has been submitted to Human Resources for approval in accordance with OMB-17-17. The same is true for individuals who received a job offer/appointment prior to January 22, 2017, and do not yet have a confirmed start date. Human Resources will contact each selectee to inform them of their status and respond to any questions they may have.

• For all other recruitment actions, including national security and public safety, offices may continue to advertise, examine, interview and communicate with candidates, however, no firm offers of employment or similar commitments may be extended unless an exemption is granted through upcoming implementing instructions.

At my agency, we just got word yesterday from HR that, building off of the recent OMB guidance, the Department is working on additional guidance for agencies. So the agency still has no instructions regarding hiring. I think its likely your hiring manager has no concrete instructions either, so you might want to wait a little longer before contacting her again - unless its been a week or more since you last contacted her. Asking for updates weekly, seems reasonable to me until you get closer to the start date in your offer.

For some agencies, they are posting critical positions that they have already had approved by OPM or are appealing to OPM to approve. The director of OPM has the authority to exempt positions from the hiring freeze, so some agencies are posting jobs that they hope to hire. Additionally, many agencies know that the civil service hiring process takes a long time and they are posting jobs so that they can collect resumes, and start the rating period for resumes. They can schedule interviews and then they'll have to go through the rating period for the interviewed candidates. For many positions, these tasks take 40-60 days to begin with. By then, who knows what the state of the hiring freeze will be and whether they can appeal or even will need to appeal to the director of OPM for an exemption. So, there are some agencies who are starting the process and will keep checking the state of the freeze as they go. The only instructions in the freeze state that they will not fill the position. And if by the time they have the right candidate, they find that a plan for reducing the federal workforce by attrition will be implemented within 15-45 days, then maybe they can negotiate an appropriate start time with the candidate to meet that restriction.
