Ok, so the AG of Virginia, Jay Jones, has filed an emergency appeal to the United States Supreme Court asking them to overrule the Virginia State Supreme Courts ruling, and while he may have sent it through spellcheck this time, he failed to change templates..because this one is still going to the Supreme Court of Virginia. The incompetence is mind blowing. 😆😆😆

You all should really check with appellate litigators before saying things are errors. They've done it correctly. Here are some other examples:

https://www.supremecourt.gov/DocketPDF/23/23A349/284940/20231013090543221_SCOTUS%20Stay%20Application.pdf
https://www.supremecourt.gov/DocketPDF/25/25A1207/407852/20260502123104939_Danco%20SCOTUS%20Stay%20Application%205-2-26.pdf

I'm not a legal expert, but those examples were asking for a "stay" of action by the appellate court. I wish someone would explain this clearly, but, along with the earlier spelling errors, etc, it does look odd.

Both Arizona and Georgia republicans expanded and packed their supreme courts when it became clear those states were going purple. .@ScottJenningsKY on Democrats going DEFCON-1 since losing their Virginia gerrymander...

“There's a better chance of me sprouting wings and flying out of that window over there than the United States Supreme Court dealing with this in any way, because this is a state Supreme Court ruling on a state constitution. The U.S. Supreme Court doesn't deal with these kinds of things, number one. Number two, the freakout in Virginia has been so extreme. You even have Democrats over there who are saying they want to effectively, politically decapitate the entire Virginia Supreme Court by putting an age limit of 54 so they can get rid of every existing justice and install people who will promise to rule a certain way on a certain case. You know, they went from, oh, this is just a temporary map thing to let's burn down the entire Virginia Supreme Court in about two seconds over there in Virginia, which tells you all you need to know about just how power hungry and corrupt the Democrats are in Virginia. This is not going to work at the U.S. Supreme Court. And this whole project of maximum warfare by Hakeem Jeffries is completely blown up in their face.”

“I mean, in Virginia, you had Democrats in Virginia who broke the law and broke the state constitution to try to move a 6-5, fairly constructed map to a 10-1. They got struck down by Democrats on their own Supreme Court, and now they want to decapitate an entire branch of government over it? It's ridiculous.”

Not what you WANT to have happen. But handicap the law here.

Will SCOTUS grant cert?

Zero chance they take the case.

The US Supreme Court has long held that state Supreme Courts have the final word on the meaning of state constitutions.

Let's not pretend that 3-4 of the Justices do not agree with ISL or that this is not an ongoing issue during the Age of MAGA. The Court HAD long held that the theory was stupid but Thomas, Alito and Gorsuch are on record supporting it.

Virginia should lose. ISL is a corrosively evil and unAmerican theory. But they should use this opportunity to argue what they don't believe to try and force a stronger holding than Moore v Harper because that dumb ass theory is likely to be raised again in 2028.

🚨Report: Democrats are trying to create a plan that will overturn the Virginia Supreme Court ruling that overturned their map

The plan would include lowering the mandatory retirement age for justices from 75 to 54 (or less). Therefore, that would remove every current justice on the court. Then the Democrat majority the state legislature would appoint 7 new justices and they would redraw the map to a 10D-1R map

Via: The New York Times

Wait until you hear what republicans did in Utah when they lost a redistricting case. The increased the number of judges of the court and created an entirely new court just for hearing redistricting cases while stripping the state Supreme Court of jurisdiction. And then for good measure, they launched a BS investigation of one of the judges who ruled against them, forcing her to resign.

Seems as if the Utah judge who resigned did so because of a HUGE conflict of interest. How did republicans “force” her to resign?

🚨New: The Utah Supreme Court Justice Diana Hagen has now resigned

She voted for the new Utah congressional map that gave Democrats an extra seat

The reason for her resignation is she allegedly had a romantic relationship with an attorney involved in the redistricting case

Interesting that this tweet doesn’t mention the fact that she recused herself from the case where he was the attorney. The complaint so obviously BS that the judicial conduct commission dismissed it, but the Utah legislature saw an opportunity to air all the dirty laundry around her divorce.

Meanwhile republicans do not care at all about Clarence Thomas accepting houses, RVs, private jet trips, vacations, etc. from parties in front of him. The also don’t care that Roberta wife gets paid millions as “consultant” to law firms appearing before him.

Exactly! All courts should be as corrupt as the SCOTUS.

Or as corrupt as the VA SC.

The author of the majority VA SC is a Democrat who was appointed by Democrat Mark Warner and approved by the Democrat majority in VA. Your assertion is that democrats are corrupt?

The VA governor does not appoint members of the VA Supreme Court. Kelsey was appointed by the VA GA in 2015 when it was controlled by republicans.

Does it really matter at this point? Judicial appointees can sometimes turn out to be awful even when appointed by the same political party (e.g., recall that Justice Souter, who was in the SCOTUS liberal voting bloc, was appointed by HW Bush). I can't make heads or tails of who was responsible for this guy getting onto the VA Supreme Court, but now the focus simply needs to be on how to fix this issue. Reducing the required retirement age makes perfect sense to me.

It matters that the PP keeps lying about who appointed him

+1

Kelsey is a conservative. Warner appointed him to the Court of Appeals. The Republicans in the GA elected Kelsey to the SC.

https://valawyersweekly.com/2015/01/20/kelsey-named-to-supreme-court/
"Virginia Court of Appeals Judge D. Arthur Kelsey was named to the Supreme Court of Virginia by the General Assembly Tuesday with the House speaker praising him as a “strong conservative jurist.”"

Facts.

Does Virginia not have any good constitutional lawyers? Why in the world are they using a California firm?

Ah that explains the inability to spell difficult words like Virginia and Senator.
