It's a public park, OP. They can do what they want.
I have a 4 yo and 18 mo old now. I tell the 4 yo all the time don't climb up the slides because someone could be trying to come down them and it's at best rude and at worst really unsafe - some big kid could come barrelling down the slide and knock her down. It says right on the signs at the park "no climbing up the slides" - it's not like a rule I made up. So I'm trying to get my daughter to follow this rule and meanwhile the daycare teachers are letting their kids do whatever they want. It sets a bad example and it is legitimately unsafe and prevents other kids from safely using the playground.
Call the daycare and speak with the director about the safety concerns. It isn't likely they will read it here.
Make up your mind first though. Is it that they are there taking up space you want to use (too bad) or is it that kids aren't being supervised?
