I actually have had this fail. I am in MD and put it on a rental car in Florida. They did not register my toll usage on my EZ Pass. After a couple of months, I got an extra charge on my credit card for the tolls and the daily rate for the SunPass usage for my stay. When I called EZ Pass to ask about this I was told that you can use an EZ pass transponder in any vehicle that is registered on the account. They verify license plate. If the license plate is not registered on the account, they don't pay and they charge tolls and penalties to the license plate owner.
When I asked if you could use the EZ pass on a rental car, she said that what I needed to do was when I got the rental assigned, I could go on the web-site and add the rental car to my EZ pass account and after 1-2 days, the vehicle would be officially added. At that point, I could use the transponder in the rental. She cautioned me to be sure to remove the car from my account when I returned the rental. If the next user of the car traveled on an EZ pass road, I could be billed for their usage if they did pay for a toll transponder on the car or if the car transponder was in one of those boxes and the new rentee did not open the box. Then since the license plate was registered to my account, I could be legally billed for the usage since I authorize that vehicle to use my EZ pass account.
