Actually if you live in VA and some of the branches are on the power lines the owner of the tree would be responsible for cutting them since they cause a hazard...at least those branches. If they give you a hard time I would just offer to split the cost.

Who summoned the tick alarmist? Kids aren't allowed to play in the grass now? You may want to start saving up for the kids' mid-life psychiatrist treatment now.

how about just training your kid to NOT walk on the berries? now there's a thought. Oh, and you should cut the tree back so that its over your property. Your neighbor surely has the money to do it but is telling you he doesn't so that you'll back off, because he knows its not his responsibility. Its passive-agressive on his part but he's in the right, you're in the wrong.


Keep some wipes by the door and wipe his feet off! How old is this kid?

OP the real question is, is the neighbor also growing (or thinking about growing) bamboo? If so you may want to call the Society Against Bamboo ("SOBs").

Our neighbor has a mulberry tree over our deck too! We cut it back. I know exactly what you are talking about, we would have purple splotches all over our entire deck, on our shoes, everywhere. Totally annoying, but you just need to take care of it yourself.

People who are saying to get use to it really have no idea how many berries fall.
