OP here: even if they do give him the full amount I'm concerned about his signing any form that says he won't sue. That is giving up a lot of rights.

At this point get a lawyer. Do not sign anything. The document you sign will be written up by a lawyer in the employ of the company- ei it will screw your husband and protect the company. Consult with a lawyer today....go for a big name, ball busting firm. This is not the time for a friend of a friend how is a lawyer, your money is on the line.

If they are making such a big deal out of it, they most likely do not have any other recourse. Make sure you husband saves all the documents need(monthly sale numbers, whatever is used to determine bonus/commission/wages). Get a lawyer, save all the emails, any meetings between your husband and these people needs to be document(and your lawyer should be there). Do not sign anything, specially a non compete on his way out. This will not be done by the time your husband leaves. It most likely will take a year or longer. Again, do not sign anything. Coming from a sale back ground, I had to deal with this a lot.
