Was the SS received by direct deposit? Because SSA will just reverse the payments, as someone above pointed out. Also-I agree that mortuary services makes a report to SSA. Not certain this is a tragedy. SSA is very quick to stop payments and reverse any over payments, so chances are it was done.
OP here. Thank you everyone. It was direct deposit and then it goes auto debit to bills. Automated system. One brother was just being mean to the other (sigh) the estate will have to pay it back, but I do not think it was a crime -- more like a mistake.

+1! It's your duty to preserve the estate. Also, if you don't, you could be setting yourself up for trouble. Let him face the consequences of his actions.
