Detained under Biden, Trump tried to send him to Guantanamo?Anonymous wrote:Anonymous wrote:Anonymous wrote:The father was the lead plaintiff suing not to go to Guantanamo Bay. Now it seems like he might have been better off there.
What do they have on him since from when he entered over a year ago in May 22, 2024, in El Paso, Texas and requested asylum he has been in custody? That seem so strange since most people with children were not detained or only briefly detained under Biden.
Just read his declaration and he says the mother of the child has been detained since October of 2024 because they have been having weekly in person visits with the child. Removing the child from the parents happened under Biden. Poor kid.
From his declaration-
7. Additionally, I do not want to be transferred to or detained at Guantanamo because I will
be separated from my partner, Yorely Escarleth Bernal Inciarte, and my two-year-old
daughter. My partner is also detained at the El Paso Processing Center. Our daughter is
currently in ORR custody. My partner and I have had weekly, in-person visits with our
daughter since around October 2024. If I am transferred to Guantanamo, I will be
separated from my family.
Biden wasn't using Guantanamo. Something is off here.
Anonymous wrote:I have been looking into this story since Friday. I have contacts in Venezuela who shared the most heart-wrenching video I have seen in my life of a woman devastated because she had been deported without her child.
It turns out I had already heard about this family, who came to the US last year and requested asylum (through the legal channels for inquiring minds!) in the following April 1st ABC news article: https://abcnews.go.com/US/family-venezuelan-migrant-recently-el-salvador-american-horror/story?id=120381541
The US sent the Maiker Espinoza Escalonal to CECOT, kept the mother Yorelys Bernal detained, and put the baby in foster care. I am incensed that the Biden administration started this horror show but the escalation by Trump is horrific. We have now deported the mother and KEPT the two-year-old!! She has no contact with the family who has her baby.
I honestly didn't know whether or not I could believe this atrocity but DHS has confirmed it. Of course they have put their dishonest/we are saviors/demonize the imigrant spin on it:
https://www.dhs.gov/news/2025/04/26/dhs-sweeps-action-protect-child-tren-de-aragua-parents
Even if the DHS accusations were believable (which they absolutely are NOT), even if there had been some kind of due process (there has NOT), this is an atrocity.
This is kidnapping.
This goes against common sense and any sense of morality. If you deport the mother -- and the mother implores you to give her back her child -- there is only one thing to do.
The US are officially kidnappers. We are officially as bad as you can get.

I don’t believe you get a free pass because you birthed children inside the country. In one thread, people are criticizing DHS for sending three American born minors to Honduras with their mother. Now, there’s criticism for taking an American born minor child from their soon-to-be deported Venezuelan parents. When it is time for their deportation, perhaps they will be given the option to take their child to Venezuela with them. Pick a lane people
Signed,

eventually the message will get out, don't come to the US illegally. and if you are in the US illegally, leave.
or there will be severe negative consequences for you and your family.
really is very simple.

DHS added that, in addition to the father, the child’s mother, Yorely Escarleth Bernal Inciarte, oversees the recruitment of young women for drug smuggling and prostitution."
Again, these two were locked up under Biden and Biden let everyone in! Biden even went so far as to fly people into the country from Venezuela and these two were still locked up!
Oh, but I'm sure their intentions were heartfelt and good. OP keeps searching for stories in an attempt to justify illegal immigration and trash the US.
1. They were not illegal.
2. I am not trying to justify illegal immigration
3. I am 100% fine with the US government deporting mother, father, and child together to Venezuela.
What I am not okay with:
1. Sending people to a maximum security prison in El Salvador, especially *without due process*
2. Deporting a mother and keeping the baby
How am I unreasonable?
You know there’s another thread here where the baby went with the deported mother, and people are angry about it. m
Did you post there and say that’s ok?
Actually, I did not post on that thread.
Way to change the subject and way to assume one size fits all.
There are many different ways to be wrong, and the Trump Administration is experimenting with as many possible to create terror. They are scaring away immigrants who are here. They are scaring away immigrants from coming. They are also ruining our trillion dollar tourism. All of these are appalling. But I am talking about something different: the good of the child.
That is the principle promoted by the United Nations and that mattered to us until just a few months ago. We used to care about the good of the child.
I am going to blow your mind here: different decisions may be made in different situations for the good of the child.
Some possible differences to take into account: If a child is an American citizen; if parent is an American citizen, if parent being deported wishes to have the child removed; if an American citizen parent thinks it is best to keep the child in the US. Why is it so hard to believe that there may be different considerations.
The unifying principle is the good of the child. ANd that is why DHS has to make up lies to demonize this couple, because there is no way to justify keeping this child when:
*the Venezuelan mother has been deported
*the child is also Venezuelan
*the mother has begged for the child to be deported with her
The Biden admin was the first to remove the child from her parents because they thought they were so dangerous. You don't trust Biden?
With regard to this administration, everyone claims that they want to get rid of any possible immigrants to pump their deportation numbers up. This would have been a very easy deportation if that were their goal since they were all denied asylum. So which is it?
Did you ever think that maybe the migrants and their families were the ones lying? They have every motivation to do so.
I have been very open about criticizing Biden. The tattoo-screening policy has been shredded. Absolutely naive, misguided, and awful. However, I DO trust Biden to require due process. I am sure he failed in many ways, but he has not burned the Constituion and spit on the ashes.
I don't understand the second question. The followed the legal channels. They went by the book. Go ahead and deny them asylum and send them home. No one on this thread is saying that that would be illegal or profoundly immoral. In fact, the message here is: Please, send them all back to Venezuela. Whatever their reasons for leaving pale in comparison to the nightmare Trump has created.
As for the migrants lying, I am sure some are. And I am sure that a small percentage of those sent to CECOT are violent criminals (respected news sources have estimated 10%, a far cry from ALL of THEM). What different does it make in this situation??? This is a moment of Moral Clarity: you deported the Venezuelan mother and she is begging for her Venezuelan child. This is a very simple and clear situation.
What is your evidence that the tattoos were the only evidence of gang membership? The parents were apparently held as soon as they got here. Biden put the child in foster care. If they thought the parents were that dangerous why would they send the child back?

I love how everyone knows deeply about El Salvador now. Is it the new Kardashians? The new White Lotus?
Most of the crime to girls and others were not in your inner circles. Spend equal time researching that.

These are tough and very challenging cases. I feel bad for everyone involved. But they are not simple and disastrous custody situations happen down the block. These cases involve one or more parent who are incarcerated.
I hope you go down to your county jail and help the moms and dads there who have been separated from their children. You can help with donations, making the visitations more hospitable, donate coloring books etc
How manipulative and disingenuous your words are. The dad is incarcerated in El Salvador because the US sent him there without due process because he has tattoos.
The mom was in detention because she had tattoos and now has been deported.
Neither has been convicted nor accused of any crime.
They came to the US as a family unit and requested asylum using legal channels. The parents are Venezuelan and the child is Venezuelan. The mother is begging for her child.
This is in fact very simple.
