As Alito said in his previous dissent, there is no case properly before the Supreme Court. They gave a ruling without having jurisdiction to hear the case.
Presumable the stage the court should weigh in is when an appeals court has ruled and someone appeals that ruling.
The Supreme Court does this all the time when district judges issue nationwide injunctions against Trump, particular Barrett not wanting to use the emergency docket.
