It really depends on the role. Yes in specialized medicine, sometimes an immigrant is truly your only option -- those people are in extremely high demand and it can take a decade or more to get the training you need to do the job. No wonder there is a shortage. Same with certain engineering specialties where American universities just do not offer these specialties or there aren't enough programs to meet demand (I've heard of this being true in certain specialties of hydraulics engineering for instance where there are African universities that have almost cornered the market on these jobs -- the US has to invest in those technologies if we want our citizens to be able to compete for those jobs).

But a lot of the jobs in banking and finance that are given to H-1B visa recipients? It's a bit of a scam. You don't think the US has enough citizens with econ degrees to fill those jobs? We do. But it's cheaper and easier to hire immigrants from India who have bog standard econ degrees from US universities or foreign universities. This is really not a necessity but the banks sure like it because it keeps the cost of this workforce down and makes it easier for them to fill roles because they get a surplus of applicants.

Sure, but no government program of that scale is without waste. Does Medicare fraud happen, sure. But we all know that it's not going anywhere. Investigae the fraud and penalize those those who are committing it.

They want to deport a bunch of low paid migrant workers doing hard labor that forms the basis of entire industries (a lot of our agriculture, the restaurant and hospitality industries) even though employers in those industries already struggle to find people who will take those jobs and taking that work force away will only raise prices further, exactly what Americans say they don't want.

But we'll hand out 100k+ jobs to wealthy foreign nationals with the idea that Americans are somehow incapable of getting degrees in computer science or finance or economics and that's fine.

Of course, Americans aren't incapable. So why don't they do it?

They do. Some of these employers prefer foreign labor because it's cheaper and it's useful to have captive employees. An H-1B employee is far less likely to job hop to increase their income because changing jobs means re-applying for their visa. That's very appealing to corporate employers for whom the H-1B process can be standardized and streamlined so it's not expensive for them. Meanwhile American applicants will never be considered for these jobs even though they are qualified.

I don't know how else to explain this but it's a scam.

What is "a lot"? How do you know which visa applicant is a future patent creator vs one who's lackluster? Do you think Trump's admin would be equipped to figure this out?

PP you quoted. I do not administer the visa process, but I have managed Federal contracts and interviewed hundreds of applicants for technical positions. Not one Satya Nadella among those needing work visas. If I was forced to hire, it more likely than not led to poor performance and firing.
Workers who came to the States 15+ years ago, when the visa fraud machine was not as sophisticated and the process was competitive, ranged from competent to amazing. But these people are now either US citizens and command competitive salaries, or went back to their home countries to run successful businesses.

You underestimate the scope of the fraud. There are companies that serve as visa clearinghouses for corporate clients which helps keep the corporations nose clean. These middlemen are engaged in a volume business -- their goal is to process as many visa applications as possible in order to yield the maximum number of successful visas. Among the fraudulent behavior of these companies is behaviors like submitting thousands of identical applications. Which means every one of those applications was fraudulent even if the company hiring an applicant had a legal reason for requesting the visa and the applicant met a legal requirement -- since the application itself ("prepared" by the clearinghouse company but actually just copied from a generic application) is fraudulent, the visa is invalid.

Yes some of these people have or will go to jail. But the corporation suffers no consequences while the immigrant faces deportation if they can't right the visa application or, if necessary, secure another job. All of which gets harder under an administration that is taking a zero tolerance policy towards immigration generally and has no empathy for the fact that the visa applicant may have been completely unaware of the fraud.

Trust me, no corporate lawyers are spending a day in prison over this. And companies like Capital One have no incentive to change how they fill these positions. Ultimately it's worth it to them to use one of these clearninghouse companies because they are often using them to fill jobs for which there is an American workforce, just one that is more expensive than the H-1B applicants. They will continue to abuse the program as long as that abuse is tolerated and if the tolerance stops they aren't really on the hook for anything because they don't actually participate in the fraud, they just benefit from it.

I think this is a class issue and that Trump has successfully turned low wage migrant workers into the boogeymen when actually the H-1B program has worse potential impacts on American workers due to fraud in the program.

Biden has already sought to crack down on fraud in the program -- look into the investigation of the contracting firm Kronsys, which falsified H-1B applications to the degree that the CEO is now serving a 12 year federal prison sentence. And H-1B holders need to be aware that because their visas are applied through and held by their employer, they will have little recourse if their employer obtains it illegally. I would expect the Trump administration to ramp up investigations into H-1B visas and would expect them to have even less leniency towards visa holders who were unaware of their employer's fraud. Trump made campaign promises about the number of deportations he'd enact and if he can use H-1B fraud to pump up his overall deportation numbers so he can say he delivered on that promise, he will.

H-1B visa holders might want to look into how their visa was obtained and on what grounds, and make contingency plans if there is any indication that there were irregularities or falsehoods in the application. Including preparing to return to home countries. I would be especially concerned if m.y visa was obtained by one of these contractors like Kronsys that process thousands of H-1B applications per year as it's apparent that many of these contractors have been engaged in systemic fraud for years.
