Did you simply run out of lane and travel onto the shoulder and immediately stop to be let in and then got pulled over? That should be easy to argue against the ticket since you didn’t really go more than a car’s length down the shoulder. You can say you were trying to get out of the way so exiting traffic could continue while you waited.

My problem is why are they assigning more points for out of state drivers. And in Maryland and DC we don't assign Virginia Drivers more points. In fact VA drivers with a safe record with 5 positive points could get pulled over 5 times in MD for driving on the shoulder at 1 point each and have zero impact points wise.
A MD driver in VA one ticket is three points and with no positive points it results in massive insurance hikes.
But since VA so tough it forces MD and DC drivers to hire lawyers to fight it. We can only hire VA lawyers connected to courts as otherwise you wont win.
Kinda Boss Hogg and Sheriff Rosco P. Coltrane approach to pulling over out of state drivers. They should just put a traffic cam in and nail people with tickets so no points and they catch 100 percent of people and no wasted court time.
So your problem is with MAryland. Virginia doesn't check your record. Doesn't care of Maryland gives safety points or not. Take it up with Maryland if you are that upset. States rights and all.
Virginia is not a state. I am upset as they assign a massive point fine to out of state people for sold purpose of being forced to pay high prices for connected lawyers to get the points back off. Seems they always win if you pay them a few hundred bucks. It is a wallet grab.
Just give me the ticket. And I do live on a cut through on Maryland side. We just have speed traps and redlight cameras and you pay the fine. None of this lets charge a million points, then you hire a local VA attorney connected to traffic courts pay a few hundred then points removed anyhow and you pay the fine.

Most people sitting in traffic watching you fly up the shoulder were probably cheering when the lights came on. In case you're curious, Maryland also has lawyers who specialize in traffic court, just like every other state
