I always assume under the influence. Because it's easier for me to believe that someone who is drunk or high could run into a family and then drive off than that a any kind of sober person could do it.

That makes sense - gives them time to sober up and get an even lighter sentence, unfortunately. I feel awful for that poor mom watching a nightmare unfold in front of her. Drivers are so reckless and impatient!
